1. Agreement to Terms

By accessing or using VideoGenie ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

VideoGenie is an AI-powered video creation and sharing platform that allows users to generate videos from prompts, edit them, and share them to social media platforms.

The Service includes video creation, processing, storage, and publication tools that integrate with third-party services including but not limited to Instagram, TikTok, and other social media platforms.

3. User Accounts

To use certain features of the Service, you must register for an account. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.

You agree to provide accurate, current, and complete information during the registration process and to keep this information updated. We reserve the right to suspend or terminate your account if any information provided is inaccurate, misleading, or incomplete.

4. Social Media Account Integration

The Service allows you to connect your social media accounts, including Instagram and TikTok, for direct publishing. By connecting these accounts, you:

  • Authorize VideoGenie to access your accounts as permitted by each platform's API
  • Confirm you have the right to grant such access
  • Agree to comply with the terms of service of those third-party platforms
  • Understand that these connections can be revoked at any time through the Service's settings or directly on the third-party platforms

5. User Content

You retain ownership of any content you create or upload to the Service ("User Content"). By using the Service to create, modify, or publish content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display your User Content for the purpose of operating and improving the Service.

You represent and warrant that:

  • You own or have secured all necessary rights to your User Content
  • Your User Content does not violate any laws, regulations, or third-party rights
  • Your User Content doesn't include or promote objectionable, deceptive, or potentially harmful content

6. Prohibited Content and Activities

You agree not to use the Service to:

  • Create or share unlawful, harmful, threatening, abusive, defamatory, or otherwise objectionable content
  • Impersonate another person or entity
  • Violate any third-party intellectual property rights
  • Engage in any activity that could disable, overburden, or impair the Service
  • Create deepfakes or impersonations of individuals without their consent
  • Distribute misinformation or deceptive content
  • Create or distribute sexually explicit or violent content
  • Attempt to reverse engineer, decompile, or disassemble any part of the Service

We reserve the right to remove any content that violates these terms and to suspend or terminate accounts that engage in prohibited activities.

7. AI-Generated Content

The Service utilizes artificial intelligence to generate video content. You acknowledge that:

  • AI-generated content may contain imperfections, inaccuracies, or unintended elements
  • You are responsible for reviewing and approving all AI-generated content before publishing
  • You must not use the AI features to generate content that violates these terms
  • VideoGenie may use AI-generated content to improve its services in accordance with our Privacy Policy

8. Intellectual Property

The Service, including its software, design, text, graphics, and other content provided by VideoGenie, is protected by copyright, trademark, and other intellectual property laws. You agree not to copy, modify, or create derivative works based on the Service unless explicitly permitted by these terms.

9. Privacy

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your information when you use the Service.

10. Termination

We may suspend or terminate your access to the Service at any time for any reason, including if we believe you have violated these Terms. You may also terminate your account at any time. Upon termination, the rights and licenses granted to you in these Terms will end.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, VIDEOGENIE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on the Service or by other reasonable means. Your continued use of the Service after such changes constitutes acceptance of the updated Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Australia, without regard to its conflict of law provisions.
